0. Application of general reservation conditions
0.1 These general reservation conditions apply to all offers, reservation requests, and agreements concluded with Camping Duinezwin concerning camping pitches, camper pitches, and holiday accommodations rented by Camping Duinezwin.
0.2 Camping Duinezwin explicitly rejects the application of other general reservation conditions.
0.3 Exceptions to these general reservation conditions are only possible if parties have agreed to them in writing.
1. General
1.1. The provision of the accommodation (the pitch or the holiday accommodation) is done by activating the in-and-out code or handing over the house keys.
1.2. Arrival is scheduled between 10 am and 6 pm. Exceptions to this rule can be made by mutual agreement. Guests who cannot arrive within the scheduled time should inform Team Camping Duinezwin.
1.3. Any complaints regarding the accommodation must be reported to Team Camping Duinezwin immediately at the start of the stay, but no later than 24 hours after the start of the stay, in order to allow Camping Duinezwin to resolve the complaint satisfactorily. After this period, no claim can be made regarding a defect in the accommodation.
1.4. On the day of departure, the camping guest must leave the accommodation by 11 am in the case of a rental accommodation and by 12 pm in the case of a camping or camper pitch, if no other departure time has been agreed upon.
2. Reservation and payment
2.1. A reservation can be requested via the campsite website (www.duinezwin.be), by email (info@duinezwin.be), or at the reception, and is binding for both the camping guest and Camping Duinezwin if the requested holiday accommodation is available during the specified period.
2.2. Camping Duinezwin only processes reservation requests from persons aged 18 and older. Camping Duinezwin reserves the right to refuse a reservation request without further explanation. After reservation of the holiday accommodation and acceptance of the reservation by Camping Duinezwin, the camping guest receives a reservation confirmation/invoice.
2.3. Payment of 100% of the total amount (incl. additional costs) must be made no later than 7 days before the arrival date via the payment page or by bank transfer to Camping Duinezwin's account number.
2.4. Late payment may result in the cancellation of the reservation.
2.5. No administration fees will be charged unless otherwise stated.
2.6. Any costs for cash deposits and/or transfers are the responsibility of the camping guest.
2.7. Payment of the total amount implies that the camping guest has read and agreed to the aforementioned general reservation conditions and the full description of the accommodation.
2.8 Specific costs or deposits specific to the accommodation will be mentioned in the reservation or rental agreement.
3. Rights and obligations of Camping Duinezwin
3.1. Camping Duinezwin is obliged to provide the accommodation to the camping guest clean and in good condition on the date and time of the start of the stay.
3.2. Camping Duinezwin may inspect the accommodation at all reasonable times or have it inspected by prospective camping guests.
3.3. Except in cases of intent or gross negligence by Camping Duinezwin, Camping Duinezwin accepts no liability for loss, theft, damage, or injury of any kind caused to or by the camping guest or the camping guest's goods during the stay and/or as a result of the use of the accommodation. Camping Duinezwin's liability, in any case, is limited to the highest amount of the total amount or the compensation of multiple costs or damages for which a normal liability insurance would provide coverage under these circumstances.
3.4. If a guest or those accompanying him or her on the campsite, or a day visitor, happens to appear in a photo and/or video taken for publication by Camping Duinezwin or display on a Camping Duinezwin website, their consent to the use of the photo and/or video in the publication is presumed, even if they are recognizable in the photo and/or video.
3.5. Camping Duinezwin reserves the right not to be liable for any typographical errors or incorrect price listings. In the event of typographical errors or incorrect price display in a reservation, Camping Duinezwin reserves the right to refuse the reservation request or cancel the reservation without cancellation costs or credits.
4. Rights and obligations of the camping guest
4.1. The camping guest may not occupy the accommodation with more people than agreed upon in the reservation, unless with written permission from Camping Duinezwin. If the number of people exceeds the agreed number without written permission, the reservation is considered dissolved without any right to compensation (meaning that the camping guest must immediately leave the accommodation and Camping Duinezwin).
4.2. The camping guest must use the accommodation exclusively as a holiday residence, may not engage in any profession or business therein, and may not rent or use the accommodation for third parties.
4.3. A group of camping guests younger than 18 years old is only allowed with written permission from Camping Duinezwin.
4.4. The camping guest must use the accommodation as a good householder, and the camping guest is liable for any damage and loss caused to the accommodation during the stay, unless the camping guest can demonstrate that the damage is not attributable to him in reasonableness.
4.5. Staying at Camping Duinezwin is entirely at the camping guest's risk. The camping guest also takes responsibility for his guests and/or family.
4.6. The camping guest must leave the accommodation clean and undamaged on the date and time of the end of the reservation. If this is not the case, Camping Duinezwin is entitled to charge additional costs.
4.7. The camping guest may bring a pet to the Camping Duinezwin and Camping Duinenhof areas with notification at the reservation. Extra costs may apply. Pets are not allowed in the “Chalet” holiday accommodation.
5. Option right
5.1. It is not possible to take an option on an accommodation offered by Camping Duinezwin unless otherwise indicated.
6. Cancellation
6.1. Due to special circumstances, Camping Duinezwin may be forced to cancel the reservation. Camping Duinezwin is obliged to inform the camping guest of this as soon as possible and within a reasonable period in writing. In that case, Camping Duinezwin will do its utmost to offer an alternative to the camping guest. If this is not satisfactory for the camping guest, Camping Duinezwin will refund all amounts paid by the camping guest pro rata, based on the number of days of stay not enjoyed. This without any liability of Camping Duinezwin.
6.2. The camping guest is entitled to cancel and dissolve the reservation, with the following considerations:
6.2.1. Cancellation must be done in writing to info@duinezwin.be.
6.2.2. In case of cancellation before 3 days before the scheduled arrival date, the camping guest will receive a full refund of the paid amount of the reservation.
6.2.3. In case of cancellation within 3 days before the scheduled arrival date, 100% of the total amount will be charged.
6.2.4. Additional administration costs may apply.
6.3. After receiving a cancellation from the camping guest, Camping Duinezwin will cancel the reservation during the opening hours of the reception. The cancellation, including any cancellation costs if applicable, will be communicated in writing to the camping guest. Any remaining balance in favor of the camping guest will be refunded. Any outstanding balance after cancellation, including cancellation costs and administration costs, in favor of Camping Duinezwin must be paid by the camping guest.
7. Changes
7.1. If a change needs to be made to a reservation already made, the camping guest contacts Camping Duinezwin. This change will be confirmed in writing by Camping Duinezwin.
7.2. Changes to the stay period are always possible, even during the stay. If the change results in the accommodation not being reserved by the camping guest during the three days following the change, this change will be considered a cancellation (see chapter 6).
8. Dissolution
8.1. Camping Duinezwin is entitled to unilaterally cancel the reservation without cancellation costs or credits, without the need for written notice if:
- the total amount has not been paid at the start of the stay.
- the camping guest leaves the accommodation prematurely.
- the camping guest, without prior notice, fails to occupy the accommodation on the day of the start of the stay by 6 pm.
- if the camping guest fails to comply with the obligations of this reservation agreement and/or the rules of order.
9. Disputes
Despite the utmost care and effort of the camping guest and Camping Duinezwin, it is still possible for a camping guest to have a legitimate complaint. The camping guest must report any complaints and technical malfunctions to Camping Duinezwin immediately in order to allow Camping Duinezwin to resolve them immediately. In the meantime, the camping guest must take all steps that can reasonably be expected of him to limit any damage. If the complaint is not resolved to the satisfaction of the camping guest, the camping guest has until 2 weeks after the complaint arises to submit the complaint in writing to Camping Duinezwin.
All disputes that may arise between the parties, and cannot be decided other than judicially, will be settled by a competent judge.
10. Other
10.1. It is possible that work is being done in the immediate vicinity of the accommodation, such as road works and/or construction activities. Camping Duinezwin and the camping guest cannot accept any responsibility or liability for any inconvenience caused.
10.2. Camping Duinezwin handles the accuracy of the information provided by the camping guest to us and the compilation and distribution thereof with the utmost care. However, we cannot guarantee that the current situation is the same as the one mentioned above, due to any changes over time.10.3.
10.3. Camping Duinezwin is not responsible for providing incorrect information, and we do not accept liability for any damage that may arise as a result.
